云时代数据主权概念及其运用前景

摘要：

"棱镜门事件"中数据传输的合法性以及云时代数据安全问题使数据主权备受关注。数据主权概念的提出主要基于主权国家维护其权威和合法性的需求、数据对国家主权的重要意义以及云时代数据主权面临的威胁等因素。虽然数据主权在国际和国家两个层面都有很强的应用前景,但其在现实中仍面临诸多难题,如数据主体行为能力的分散化、国内数据的不确定性、数据量实际操作难度大、网络空间技术挑战以及数据管制和开放的平衡等。
