摘要：

"孤儿作品"存在已久,但是对其的研究在我国还比较新。在数字化时代对海量数据需求环境下,对"孤儿作品"的保护显得更为重要。许多情况下,要想获得"孤儿作品"权利人的授权,对使用人来说极为不便,在某些情况下甚至不可能,因此,有必要研究一套使"孤儿作品"得到有效使用的方案。本文通过介绍"孤儿作品"的渊源和国外的一些先进的做法,结合我国国情,提出对保护和利用"孤儿作品"的一些合理化建议。
