摘要
算法共谋是当今世界反垄断规制的最大的难题,主要的原因在于如何发现共谋和缺乏主观意图下的算法共谋的法律认定和判断上。数字经济形成的极度透明的市场,使垄断协议概念在数字经济中局限化,挑战了反垄断执法机关对算法共谋违法的判断标准。被称为黑匣子的隐蔽、不透明的算法技术,增加了识别利用人工智能手段进行算法共谋的难度。算法共谋承担责任的主体也存在着较大的争议,使人类和机器的责任模糊化。本着谦抑性地干预算法共谋的谨慎态度,尝试性地提出一些规制算法共谋的监管措施,以期实现保护自由竞争、保障消费者的合法权利和促进创新平衡的效果。
